Construction and Urban Transformation Law

Urban transformation begins when a building is designated as a risky structure under Law No. 6306. The designation is annotated on the title and notified to the owners; the period to object is 15 days from notification. Following the February 2026 amendment to the implementing regulation, decisions on a risky building are taken by an absolute majority of owners calculated by land share; the shares of owners who do not agree can be put up for sale under the statutory procedure. A flat-for-land construction contract must be drawn up by a notary.

Scope of our work

Procedures under Law No. 6306

Designation of buildings as risky, objections before the Ministry of Environment, Urbanisation and Climate Change, applications against demolition orders, decision-making among owners and the sale of shares of non-consenting owners.

Flat-for-land and revenue-sharing construction contracts

Contracts between developers and landowners are drafted in detail, covering delivery dates, penalty clauses, materials and technical specifications, bank guarantees and termination terms, and executed in notarised form.

Delay and defective work

Where construction is not delivered on time, claims for delay compensation and lost rent are filed. For buildings delivered with apparent or latent defects, evidence is preserved through court determination and diminution in value and repair costs are claimed.

How does the process work?

  1. A risk assessment is carried out by an organisation licensed by the Ministry and annotated on the title.
  2. The designation is notified to owners; the 15-day objection period starts on that date.
  3. Owners meet and decide on the project, developer and allocation by absolute majority of land shares.
  4. The flat-for-land contract is signed before a notary, setting delivery date, penalties and guarantees.
  5. After demolition and construction, new units are registered to the owners according to the contract.

Deadlines to keep in mind

  • Objection to risky building designation: 15 days from notification.
  • Action against administrative acts under Law No. 6306: 30 days from notification.
  • Notice of defects: apparent defects on delivery, latent defects without delay once discovered.

Frequently asked questions

My building has been designated as risky. What should I do?

Note the date of notification; the objection period is 15 days. Then have any draft agreements reviewed before signing, to protect your rights during owners’ meetings and developer selection.

What majority is needed for decisions in urban transformation?

Under the regulation amendment in force since 4 February 2026, decisions on risky buildings are taken by an absolute majority of owners calculated by land share, not by headcount. The shares of non-consenting owners can be sold under the statutory procedure.

What if the developer delivers late?

The contractual penalty and delay compensation can be claimed, and the contract can be terminated if the conditions are met. Lost rent during the delay can also be claimed.
